DISTANCE SALES AGREEMENT

Article 1 – Parties

This Distance Sales Agreement (“Agreement”) is concluded electronically between the SELLER, whose details are set out below, and the BUYER placing an order through the Site, upon the BUYER’s confirmation of the order.

BUYER:
The BUYER’s name, address, phone number and e-mail address are as declared by the BUYER at the time of order and as shown on the order confirmation/invoice.

Article 2 – Subject of the Agreement

The subject of this Agreement is to determine the rights and obligations of the parties, in accordance with Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product ordered electronically by the BUYER through the SELLER’s website mwf-metaldetectors.com, the qualities, sale price and payment method of which are specified in the order/invoice information.

Article 3 – Information on the Product Subject to the Agreement

The type, quantity, brand/model, sale price and delivery details of the product are as stated in the order summary confirmed by the BUYER at the time of order and/or in the order confirmation/invoice sent by e-mail, and form an integral part of this Agreement.

Article 4 – General Provisions

  • The BUYER acknowledges having read and understood the preliminary information on the Site regarding the essential characteristics, sale price, payment method and delivery of the product subject to the agreement, and confirms this electronically.
  • The product will be delivered to the address specified by the BUYER at the time of order, within 30 (thirty) days at the latest from the order reaching the SELLER, unless otherwise expressly stated.
  • If delivery exceeds 15 (fifteen) days, the BUYER may cancel the order and request a refund of the amount paid; this is also consistent with the Company’s current Return/Exchange Policy.
  • If the product is to be delivered to a person/entity other than the BUYER, the SELLER cannot be held responsible if that person/entity refuses to accept delivery.

Article 5 – Right of Withdrawal

The BUYER may exercise the right of withdrawal from the Agreement, without any legal or criminal liability and without giving any justification, by refusing the goods within 14 (fourteen) days of delivery to the BUYER or to the person/entity at the address indicated. Given the nature of the products, the SELLER extends this period and also offers a 15 (fifteen) day return option. To exercise the right of withdrawal, the SELLER must be notified in writing within this period via info@mwf-metaldetectors.com or the contact details above, and the product’s invoice, box and any standard accessories must be returned complete and undamaged.

Article 6 – Cases Where the Right of Withdrawal Cannot Be Used

In accordance with Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be used for products specially prepared/customized at the BUYER’s request or for personal needs, or for products whose packaging, tape, seal or box has been opened after delivery and which are not suitable for return by their nature. In addition, if the product has not been used in accordance with the SELLER’s current Return and Warranty Policy, or has been damaged due to incorrect use, or its quality has deteriorated, the return request will be evaluated subject to the provisions of that policy.

Article 7 – Default and Its Legal Consequences

Where the BUYER defaults on payments made by bank or credit card, the BUYER accepts that they will pay interest under the credit card agreement with the card-issuing bank and will be liable to the bank accordingly. The SELLER reserves the right to inform the BUYER and to offer an alternative product or a refund in cases such as delayed delivery or insufficient stock.

Article 8 – Competent Court

In the application of this Agreement, the Consumer Arbitration Committees and Consumer Courts at the BUYER’s place of residence are competent, up to the value announced by the Ministry of Trade.

Article 9 – Effect

By completing payment for an order placed through the Site, the BUYER is deemed to have read, understood and accepted all terms of this Agreement.
